Give one reason each to argue that the Indian judiciary is independent with respect to:

a) Appointment of judges

b) Removal of judges

c) Powers of the judiciary

a) Appointment of the judges is an independent process it is appointed by the President of India on the advice of the chief justice of India. On the basis of the seniority and the merit of their career judges are appointed and there are minimum chances of political interference in the appointment of the judge.

b) If any misconduct is done by the judge of the supreme court or judge of the high court, then removal of such a judge is a necessity, for this, there is a provision in the Indian constitution. A motion of impeachment should be passed with a two-thirds majority of both the house of Parliament.

c) Indian constitution has deliberately kept aside the judiciary system out of political control. Wherever it is necessary the judiciary system uses its power. We are neither having judiciary supremacy, nor we are having parliamentary supremacy we are having the balance of both.
